1. General

This Privacy Policy applies to the personal data (hereinafter, the “Data”) we collect from you to enable us to  provide you with the products and services we offer.

We attach particular importance to the protection of your personal data, in accordance with the provisions of Regulation (E.U.) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, as well as the Law of 30 July 2018 on the protection of individuals with regard to the processing of personal data.

By using our solution or by communicating your Data to us when requesting information, commercial offers, directly or with our partners, you accept the practices described in this Privacy Policy. If you do not accept the provisions of this policy, please do not use our solution and do not communicate your Data to us. In this case, you agree not to benefit from all the services and other advantages offered by VIASAT CONNECT.

2. Contact details

VIASAT CONNECT NV (hereinafter: “VIASAT CONNECT”), whose registered office is located at Avenue Herrmann-Debroux 54, 1160 AUDERGHEM (Belgium) and registered with the Crossroads Bank for Enterprises under the number (BE) 0426.340.140, acts as :

  • Processor of the Data collected through our solution and for the purposes described below.
  • Sub-processor of the Data collected by VIASAT CONNECT on behalf of our Clients.

3. What data do we collect, for what purpose and on what legal basis?

It is the Data that you communicate to us on the one hand directly or through the SECURYSAT solution and on the other hand through cookies deposited by us or more generally by third party services.

We will only use the Data in the context of the processing purposes described below.

3.1. Data processing carried out as Data Controller

3.1.1. Registration and creation of a user account

The purpose of this processing is to allow us to register you, to verify your identity and to create and manage a user account in order to benefit from our services.

The categories of personal data processed in the context of this processing are: your identification data (surname, first name, company name and address), your contact data (email address and telephone number), your electronic identification data (login, password), your connection data (logs, IP address, browser version, etc.), your language preferences.

The legal basis for this processing is the performance of a contract.

We keep your Data for as long as your registration is effective.

3.1.2. Maintenance of user accounts

The purpose of this processing is to enable us to manage your user account, to ensure security and reliability, to prevent fraud and abuse of our services, to manage requests from data subjects and to provide user support.

The categories of personal data processed in the context of this treatment are: your identification data (name, first name, company name and address), your contact data (email address and telephone number), your electronic identification data (login, password), your connection data (logs, IP address, browser version, etc.), your language preferences.

The legal basis for this processing is the performance of the contract.

We keep your Data for as long as your registration is effective.

3.1.3. Personalised use of the Service

The purpose of this processing is to personalise the use of the Service when you configure your account settings.

The Data processed are the following: account preferences, information related to your account.

3.1.4. Support

The purpose of this processing is to provide support related to the Service, answer questions and process requests.

The Data processed are the following: account information, content of the request.

3.1.5. Ensuring the quality of the Service

The purpose of this processing is to provide you with a quality Service adapted to your needs.

3.2. Data processing as a subcontractor

We process your Data on behalf of our Clients and in accordance with their instructions in the context of the services we provide to them. In doing so, we act as a Data processor. Our client acts as the data controller.

In this respect, we comply with the applicable regulations on the protection of personal data and assist you in exercising your rights as a data subject.

For more information on the implementation of these processing operations and in particular on how long the Data are kept, we refer you to the privacy policies of our Clients and to the service contracts binding us to them.

Our solutions use cookies.

A cookie is a small file distributed with the pages of an application and stored by the browser on the hard drive of your computer, tablet or phone. 4. How long do we keep your data?

We keep your Terrain Data for the period of time defined by our Clients, who are responsible for the processing. Otherwise, this period is set at three months.

Your Identification and Contact Data are kept for the duration of the service contract.

Your Connection Data are kept for a period of twelve months.

At the end of these retention periods, we make every effort to ensure that your Data are rendered inaccessible.

5. To whom may your Data be disclosed?

Your Data may be passed on, for the above-mentioned purposes, on the one hand to dealers belonging to the VIASAT CONNECT group and who market SECURYSAT solutions and, on the other hand, to dealers not belonging to the VIASAT CONNECT group and who market SECURYSAT solutions.

In the course of providing our services, in particular in order to enable the solution to function n, we may have to subcontract, in whole or in part, some of our missions to technical subcontractors who are bound to us by contracts.

The main subcontractors likely to be involved in the processing of data collected through the Securysat solution are :

VIASAT CONNECT requires its subcontractors to comply with the Data Protection legislation and to present sufficient guarantees regarding the implementation of appropriate technical and organisational measures, so that the processing meets the requirements of the applicable Data Protection legislation and guarantees the protection of your rights.

We do not sell or otherwise disclose the Data we collect about you to third parties.

In some circumstances, our website and applications may provide you with plugins from various social networks. If you choose to interact with a social network site such as Facebook, LinkedIn or Twitter, your activity on our site or through our applications will also be accessible on that social network. Please read the privacy policies of these social networks for detailed information about the collection and transfer of personal information, your rights and how you can obtain a satisfactory data privacy setting.

8. What happens in case of a dispute?

If you believe that we are in breach of any of our legal and/or contractual obligations, please contact us by email at dpo@viasatconnect.be. We will make every effort to follow up with you as soon as possible.

Any claim, complaint or grievance shall be addressed to the VIASAT CONNECT head office.

If you are not satisfied with our response, you have the right to lodge a complaint with a supervisory authority.

9. Information about children

As a general rule, we do not intentionally collect personal information from children under the age of 13. If we discover that we have inadvertently collected information from children under the age of 13, we will take steps to delete the information as soon as possible, unless we are required to retain it by applicable law.

If, however, we do collect information from children under the age of 13, we will obtain the consent of the holder of parental responsibility for that child before using his or her personal information.

We have no control over how third party sites and services handle your personal information. We have developed technically and organizationally appropriate security rules to prevent the destruction, loss, falsification, alteration, unauthorized access, accidental disclosure to third parties and any other unauthorized processing of Data.

12. Limitation of liability clause

VIASAT CONNECT’s liability shall be limited to direct damage, to the exclusion of any indirect damage. VIASAT CONNECT may never be held liable for damages deemed to be indirect, such as, but not limited to, loss of Data, financial or commercial loss, loss of profits, increased overheads, disruption of planning.

Furthermore, VIASAT CONNECT shall not be liable for any damage resulting from illegitimate manipulation of the Data by third parties (theft of Data, viruses, phishing or other computer crimes).

We would also like to point out that the links to the Website may contain hyperlinks and other references to other websites that we do not manage or control and to which these provisions do not apply. We are not responsible for the content of these websites or for the offers, products and services they provide. We therefore recommend that you carefully read the privacy policy of each website you visit, as this policy may differ from this one.
